Biden’s team is preparing to make the federal bench more diverse by identifying judicial candidates who are historically underrepresented. However, there is a wild imbalance: Goliath —judges who used to represent the government in court outweighed David—judges who battled the government in court in number. Both libertarians and progressive legal activists agree on the point that to further stack the deck with Goliath is unfair to individual litigants and also a bad look for the justice system. It is pointed out that it’s substantive diversity that is much-needed, instead of cosmetic diversity. Though Biden has long been an inveterate promoter, there is still scope for amends, for instance, nominate judges who battled the government in court.
