租房房东问题
When living in China, you need to settle down with a nice apartment, and you need to sign a lease to ensure you can enjoy the time in this apartment.
当外国友人来到中国定居生活时,需要租房。而在租房时,需要签订一份房屋租赁合同以保障自己的合法权益。
In the lease, normally you will have generally introduction about this apartment, term of the lease, how and when to pay your rent, how to renew the lease, how to pay electricity and water bills,who should bear the responsibility to fix the apartment, about sublease,about returning the apartment, termination of the lease,liabilties of breach,dispute resolutionand other terms.
在租赁合同中,通常具备的条款是:房屋基本状况、租赁期限、租金及交付方式、续租、费用承担、房屋修缮与使用、房屋转租、房屋返还、合同解除、违约责任、争议解决方式等。
In part one, generally introduction about this apartment, the lease needs to state where does the apartment located, how big is the apartment and other details, and you need to ask the landlord to state that he has the right to lease this apartment to you.
在房屋基本状况这一条款中,通常会表明房屋的坐落、面积等信息,您需要让房东表明他是有权将房屋出租给您的。

You need to be aware that it's always better to rent apartment from the owner instead of the sublease owner.
需要注意的是,您最好是选择与房屋所有权人租房,而不是跟二房东租房。
In some cases, because the sublease owner has issues with the owner(for example, the lease or authorization between them expired), it could affect the stability of your lease, the owner might want to raise the rent, or retrive the apartment and you need to find other apartment in a short notice.
因为二房东与房东之间可能会产生纠纷(比如,他们之前的租房合同或授权出租过期了),这会影响您的租赁合同的稳定性,房东可能想要加租,或者收回房屋导致您要在短时间内重新找房。
When the owner try to retrive the apartment, if the sublease owner refuse to cooperate, you might lose your deposit. Because sublease owner takes your deposit and hold it, and there is a chance that he didn't hand it over to the owner and he refuse to return to you when the owner ask you to move out.
当房东收回房屋时,二房东却不愿意配合的话,您很可能就会失去租房押金。因为二房东收取您的租金后,他可能没有移交给房东,在房东要求您搬走时,二房东可能会拒绝退还押金给您。
If you happened need to sign a lease with sublease owner, you should always ask for these following documents in order to protect yourself. For example, a lease between the owner and sublease owner, it needs to state that the sublease owner has right to sublease this apartment. Or an authorization from the owner, states that the sublease owner has right to sublease this apartment.
如果你不得不与二房东签订租赁合同,那您最好要求他出示以下文件。比如,房东与二房东之间的租赁合同,显示二房东有权将房屋转租给他人。或者是房东出具的授权书,表明二房东有权转租。
