今天讨论的话题是如果一个项目EOT了,是否就意味着承包商有权索赔因延期产生的费用,专门的英文单词是Prolongation Cost.
根据今天专家的意见,并不是EOT了,就可以索赔与时间相关的费用,即prolongation cost。大多数情况下,必须要证明该延误仅由于业主单方面的原因造成,承包商才有权索赔时间延长相关的费用。如果是共同延误,或者由于不可抗力延误,大部分情况下不得索赔prolongation cost,具体项目需按照合同条款专项分析。
那么难题来了:
1-如何计算prolongation cost,这项费用一般包括哪些?
Given that this delay is solely attributable to the Employer, the Onshore Contractorshall be entitled to be paid by the Employer for such additional Cost due tothe prolongation for general expenditure of the Project and Headquarter Management including but not limit to the management cost, insurance and bondscost, staff salary and wages, daily expenses, vehicles expenses, travelexpenses, site main camp management cost etc. The Onshore Contractor shallevaluate the above-mentioned costs in detail and submit to the Employer as perContract Clause 20.2 for its determination.
包括onshore和offshore总部的管理费,如果是上市公司最好,直接按照比例即可。
或者onshore部分当地市场是否有定额,原则,机制?其他类似或者工程类项目的人员,承包商费用标准,当地如何测算?

3-如何证明该延误完全是业主的原因导致?不存在共同延误?
